Most order problems are solved with a phone call or an email — a wrong item, a shipping delay, a question about a return. This page explains, in plain language, how we handle disagreements that our regular customer support can't resolve on the spot, including the formal process, your rights under U.S. consumer law, and where to turn if you want a second opinion.

OUR PHILOSOPHY

We would rather fix the problem than fight about it

Because our catalog includes hidden-camera, audio, GPS-tracking, and detection products, we know order disputes can sometimes get tangled up with questions about how a product was used or whether it worked as expected in a specific legal context. This page separates those concerns clearly: it covers disagreements about your order, your product, or your account — not the underlying legality of how you choose to use a device, which is addressed in our Product Disclaimer.

This Dispute Resolution page is part of, and should be read together with, our Terms of Service. If a specific term below ever conflicts with the Terms of Service, the Terms of Service controls. Nothing on this page is legal advice, and it does not limit any right you have under law that legally cannot be waived by agreement.

STEP 2 — IF WE HAVEN'T RESOLVED IT

Send a written Notice of Dispute

If customer support hasn't resolved your issue to your satisfaction, both you and All My Teck agree to try to resolve the dispute informally, in writing, before either side files an arbitration claim or a lawsuit.

60-day good-faith negotiation period

Both sides agree to negotiate in good faith for at least 60 days after the Notice of Dispute is received before starting arbitration or a court case (except claims that qualify for small claims court, which may proceed at any time).

Still unresolved after 60 days

If we can't reach an agreement within that window, either party may proceed to binding arbitration as described below, or to small claims court where the claim qualifies.

BINDING ARBITRATION

Individual arbitration under the Federal Arbitration Act

If informal negotiation doesn't resolve a dispute, most claims covered by our Terms of Service will be resolved by binding, individual arbitration rather than in court, as described below.

How arbitration works

Arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single neutral arbitrator rather than a judge or jury. For claims under $10,000, the arbitration will generally be conducted based on documents submitted, by phone, or by video conference, unless you specifically request an in-person hearing, which the AAA rules permit.

Arbitration will take place in Sheridan County, Wyoming, unless you and All My Teck agree to a different location, or unless applicable law requires a different location for consumers based on their state of residence.

Who pays the arbitration fees

For claims of $10,000 or less that are not found to be frivolous, All My Teck will pay the AAA's filing, administrative, and arbitrator fees, and you will not be responsible for these fees beyond what you would have paid to file a claim in court. Each party bears its own attorney's fees unless the arbitrator awards fees as allowed by applicable law.

Governing law

This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1–16). Except as the FAA requires otherwise, the substance of any dispute is governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles, and without regard to the United Nations Convention on Contracts for the International Sale of Goods.

YOUR RIGHT TO OPT OUT

You can decline the arbitration agreement

You may opt out of this arbitration agreement — including the class action waiver below — by sending written notice to support@allmyteck.com or to Shopikings LLC, 30 N Gould St #24180, Sheridan, WY 82801, within 30 days of your first order or of this policy's effective date, whichever is later.

Your notice must include your name, order number or account email, mailing address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of your relationship with All My Teck, including your ability to shop, return items, or receive support.

CLASS ACTION WAIVER & SMALL CLAIMS

Individual claims, with small claims court preserved

No class or consolidated actions

To the fullest extent permitted by law, disputes must be brought individually, not as a plaintiff or class member in any purported class, consolidated, or representative action. The arbitrator has no authority to combine more than one person's claims or to preside over any form of a class proceeding. Some states limit or do not permit this kind of waiver for certain claims; where that is the case, this provision does not apply to the extent state law prohibits it, and the rest of this agreement remains in effect.

Small claims court is always available

Either party may instead bring an individual claim in small claims court — in the county where you reside, or in Sheridan County, Wyoming — if the claim qualifies under that court's monetary limit, which varies by state (commonly between $2,500 and $25,000). Choosing small claims court does not require arbitration first.

STATE-SPECIFIC CONSUMER PROTECTIONS

Rights this agreement does not take away

Arbitration changes where a dispute is heard, not the substantive consumer rights you have under state or federal law. The protections below apply regardless of the resolution method used.

Little FTC Acts & state consumer-protection statutes

Every state maintains its own unfair-and-deceptive-practices statute — for example, California's Consumers Legal Remedies Act and False Advertising Law, or New York's General Business Law § 349. These statutory rights and remedies are not eliminated by this policy; they can still be pursued through arbitration on an individual basis, or through small claims court where eligible.

Warranty rights under the Magnuson-Moss Warranty Act & UCC

Implied warranty protections under your state's adoption of the Uniform Commercial Code, and disclosure requirements under the federal Magnuson-Moss Warranty Act, apply to any written warranty we provide. Our Product Disclaimer explains how our AS-IS terms interact with these protections; some states do not allow certain warranty disclaimers, in which case state law controls.

Fair Credit Billing Act — card chargeback rights

If you paid by credit card, the Fair Credit Billing Act gives you the right to dispute a charge directly with your card issuer under certain circumstances, separate from — and in addition to — the process on this page. We ask that you contact us first, since most issues are resolved faster this way, but nothing here removes your right to also contact your bank or card issuer.

States that restrict pre-dispute arbitration or class waivers

A small number of states place limits on enforcing certain arbitration or class-waiver clauses against consumers in specific circumstances. Where a provision of this agreement is found unenforceable under your state's law, only that provision is set aside — the remainder of this Dispute Resolution policy, including the informal-resolution and small-claims provisions, continues to apply.

Frequently asked questions

Do I have to go through arbitration for every kind of problem?

No. Straightforward issues like a wrong or damaged item, a late shipment, or a refund request are handled directly through customer support and our published Shipping and Refund policies. Arbitration only becomes relevant for a dispute that support and the informal Notice of Dispute process could not resolve.

What if my dispute is actually with a manufacturer, not All My Teck?

Start with us regardless. We coordinate with our manufacturers and distributors on defect claims and warranty issues, so contacting All My Teck first is usually the fastest path even when the underlying issue originates with the product's manufacturer.

Does this page apply to disputes about how a product may legally be used?

This page governs disputes between you and All My Teck over your order, product, or account. It does not answer legal-use questions about recording, tracking, or monitoring — see our Product Disclaimer for that, and consult an attorney for advice specific to your situation.

Can this policy change after I've placed an order?

We may update this page as our business or the law changes; the effective date at the bottom reflects the current version. For an existing dispute, the version of this policy in effect at the time you placed the relevant order will generally apply, unless a change is required by law.
