Under 18 U.S.C. § 2511, part of the ECPA, it is generally lawful to record an oral, wire, or electronic communication if at least one participant in the conversation — which can include you — consents to the recording. This is commonly called the "one-party consent" standard. Intentionally intercepting, recording, using, or disclosing the contents of such a communication without the consent required by law is a federal crime and can also create civil liability for damages.

A number of states require the consent of every participant to a private, in-person or telephone conversation before it may be recorded — not just one party. States commonly cited as applying an all-party ("two-party") consent standard, at least in certain circumstances, include:

The exact scope, exceptions (for example, recordings made in public or where there is no reasonable expectation of privacy), and penalties differ from state to state, and this list can change as state legislatures act. The federal Video Voyeurism Prevention Act of 2004, together with a video-voyeurism or "hidden camera" statute in nearly every U.S. state, prohibits using a camera to capture an image of a person in a place where they have a reasonable expectation of privacy — such as a bathroom, changing room, locker room, or bedroom — without their knowledge or consent, regardless of who owns the property. Employers who monitor employees, and hosts or landlords who monitor rental or common areas, are generally subject to state notice and disclosure requirements in addition to the consent rules above.
